Rahul Gandhi’s expulsion from Lok Sabha
Wayanad’s Member of Parliament and opposition leader Rahul Gandhi, has been disqualified from the Lok Sabha. The action was taken post a ruling on a defamation case in a local court in Surat.
A notification issued by the Lok Sabha Secretariat on Friday said Rahul “stands disqualified from the membership of Lok Sabha from the date of his conviction i.e. 23 March 2023 in terms of the provisions of Article 102(1)(e) of the Constitution of India read with Section 8 of the Representation of the People Act, 1951”.
Section 8 states “a person convicted of any offence and sentenced to imprisonment for not less than two years shall be disqualified from the date of such conviction and shall continue to be disqualified for a further period of six years since his release.”
Hence, this ruling can keep Rahul Gandhi away from parliament, for next 8 years.
Reasoning behind the notification: In October 2015, Election Commission notified and asked chief secretaries to set a procedure to manage MPs and MLAs with prosecution cases. The purpose was to make the speaker of the house aware, and a cautionary action can be taken.
Response by Opposition: As per Mr Gandhi’s team, Congress plan to counter the verdict by petitioning in higher court, and if not, Supreme Court. Experts also said that a two-year sentence in a criminal defamation case under Section 499 of the Indian Penal Code, under which Mr Gandhi was convicted, is extremely rare.
Happiness Index results
For the sixth year in a row, Finland held the top spot on the World Happiness Index 2023. Whereas, India stood in 125th position. Denmark stood second, followed by Iceland, Israel and Netherlands holding third, fourth and fifth positions respectively.
On the 20th of March of every year, World Happiness Day is observed and the Global Happiness Report is published by the UN Sustainable Development Solutions Network.
